These Terms of Service ("Terms") govern access to and use of GetTheQuote, a software service for creating, managing, sharing, and approving quote pages for small renovation, painting, decorating, and similar home improvement projects.
Acceptance of These Terms
By creating an account, signing in, accessing a quote page, approving a quote, or otherwise using GetTheQuote, you agree to these Terms. If you do not agree, do not use the service.
If you use GetTheQuote on behalf of a business, you represent that you have authority to bind that business to these Terms.
The Service
GetTheQuote helps contractors and small home improvement professionals create branded quote pages with project details, scope items, pricing, exclusions, terms, notes, photos, business profile information, and customer approval.
GetTheQuote is a quote presentation and workflow tool. It is not estimating software, construction management software, legal advice, financial advice, tax advice, or professional contracting advice. Users are responsible for deciding what to quote, how to price work, which terms to include, and whether a quote is appropriate for a specific project.
Accounts and Authentication
You may need an account to create and manage quotes. GetTheQuote supports sign-in through Google and may rely on third-party authentication providers.
You are responsible for:
- Providing accurate account and business information.
- Keeping your account secure.
- All activity that occurs under your account.
- Promptly notifying us if you believe your account has been compromised.
We may suspend or terminate accounts that violate these Terms, create risk for the service, or appear to be used fraudulently or unlawfully.
Contractor and Customer Relationships
GetTheQuote is not a contractor, subcontractor, agent, broker, marketplace, payment processor, insurer, or party to any home improvement agreement between a contractor and a customer.
Contractors are solely responsible for:
- The accuracy of quote content, pricing, timelines, exclusions, project terms, and customer communications.
- Performing any work they agree to perform.
- Required licenses, registrations, permits, insurance, bonding, warranties, tax obligations, consumer notices, cancellation rights, and other legal requirements.
- Complying with laws that apply to their trade, location, and customers.
- Resolving disputes with customers.
Customers are responsible for reviewing the quote carefully before approving it and contacting the contractor with questions before signing.
Quotes, Estimates, and Approval
A quote page may include scope items, optional items, project photos, total price, timeline, validity date, exclusions, project terms, and contractor contact information.
Unless the contractor's own quote terms state otherwise, approval through GetTheQuote only records that the customer reviewed and approved the displayed scope and estimate. Approval does not, by itself:
- Collect payment.
- Guarantee scheduling.
- Guarantee that work will be performed.
- Replace permits, inspection approvals, change orders, statutory notices, or other documents required by law.
- Create a contract with GetTheQuote.
Contractors may include their own project terms, deposit policies, payment schedules, change order rules, and other conditions in each quote. Those contractor-provided terms are the contractor's responsibility.
Electronic Signatures
Some quote pages allow a customer to approve a quote by entering a name and drawing or submitting a signature. By approving a quote, the customer represents that:
- The name and signature are accurate.
- They are authorized to approve the quote.
- They intend the approval to be associated with the quote shown at the time of approval.
GetTheQuote stores approval information such as approver name, signature image, approval time, approved total, and selected scope. We do not guarantee that any electronic approval or signature will be enforceable for every transaction, location, or use case. Contractors should consult legal counsel about signature, notice, and contracting requirements that apply to their work.
User Content
"User Content" means information, files, images, logos, business details, customer details, quote text, project descriptions, pricing, scope items, signatures, and other content submitted to or generated through GetTheQuote.
You retain ownership of your User Content. You grant us a limited license to host, store, process, copy, display, transmit, and otherwise use User Content as needed to provide, maintain, secure, and improve GetTheQuote.
You represent and warrant that:
- You have the rights and permissions needed to submit and use your User Content.
- Your User Content is accurate to the best of your knowledge.
- Your User Content does not violate the rights of others.
- Your User Content does not include unlawful, misleading, abusive, discriminatory, infringing, or harmful material.
Do not upload payment card numbers, government identification numbers, medical information, or other highly sensitive information unless we expressly provide a supported feature for that information.
Project Photos, Logos, and Public Quote Links
The service may allow contractors to upload business logos and project photos. Uploaded images may be displayed on quote pages and may be stored using third-party infrastructure.
Quote pages marked as non-draft or shared by link may be viewable by anyone with access to the link. Contractors should avoid including private, confidential, or unnecessary personal information in quote pages or uploaded photos.
We may remove or restrict access to content that violates these Terms, creates security risk, infringes rights, or is otherwise inappropriate for the service.
Customer Information and Privacy
The service may process names, email addresses, phone numbers, project addresses or areas, signatures, quote details, business profile information, and uploaded images.
Contractors are responsible for obtaining any permissions required to submit customer information to GetTheQuote and to share quote links with customers.
Acceptable Use
You agree not to:
- Use GetTheQuote for unlawful, fraudulent, deceptive, or harmful activity.
- Misrepresent licenses, insurance, qualifications, pricing, availability, or project terms.
- Upload malware, harmful code, or content designed to disrupt the service.
- Attempt to access accounts, quotes, data, systems, or infrastructure without authorization.
- Scrape, reverse engineer, overload, or interfere with the service except as allowed by law.
- Use the service to send spam or unsolicited communications.
- Upload content that infringes intellectual property, privacy, publicity, or other rights.
- Use the service for projects or industries where GetTheQuote is not suitable without independently verifying legal and professional requirements.
Third-Party Services
GetTheQuote may rely on third-party services for authentication, hosting, database storage, file storage, email delivery, analytics, and other infrastructure. Examples may include Google authentication, Supabase, and Resend.
Third-party services are governed by their own terms and policies. We are not responsible for third-party services outside our control.
Fees, Billing, and Paid Plans
Quote page approval does not collect payment from customers.
If we offer paid subscriptions, trials, usage-based fees, or other paid plans, the applicable pricing, billing cycle, renewal terms, taxes, cancellation method, and refund policy will be disclosed at or before checkout. If a paid plan renews automatically, we will provide a cancellation method as required by applicable law.
You are responsible for all fees and taxes associated with your account unless otherwise stated in writing.
Availability and Changes
We may modify, suspend, or discontinue parts of GetTheQuote at any time. We may also update features, limits, templates, workflows, and integrations.
We aim to keep the service useful and reliable, but we do not guarantee uninterrupted availability, error-free operation, data retention for any specific period, or compatibility with every browser, device, workflow, or legal requirement.
Templates and Default Language
GetTheQuote may provide built-in quote templates, default terms, exclusions, notes, or example language. These materials are provided for convenience only.
Contractors must review and edit templates before using them with customers. We do not guarantee that built-in language is complete, accurate, legally sufficient, or appropriate for any specific project, trade, customer, or jurisdiction.
Intellectual Property
GetTheQuote, including its software, design, branding, templates, workflows, and other service materials, is owned by us or our licensors and is protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use GetTheQuote for your internal business purposes and customer quote workflows.
You may not copy, resell, sublicense, or commercially exploit the service except as expressly allowed by us in writing.
Feedback
If you send us ideas, suggestions, or feedback, you grant us permission to use that feedback without restriction or compensation to you.
Disclaimers
GetTheQuote is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
- Quotes created through the service will be legally enforceable.
- Customer approvals will create a valid contract.
- Pricing, scope, timelines, or templates will be accurate.
- Contractors will perform work as promised.
- Customers will approve quotes, pay contractors, or proceed with projects.
- The service will meet every legal, trade, licensing, or insurance requirement.
Limitation of Liability
To the fullest extent permitted by law, GetTheQuote and its owners, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost data, loss of goodwill, project disputes, customer disputes, or contractor performance issues.
To the fullest extent permitted by law, our total liability for all claims relating to the service will not exceed the greater of:
- The amount you paid to us for the service during the three months before the event giving rise to the claim; or
- USD $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless GetTheQuote and its owners, employees, contractors, agents, affiliates, and service providers from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to:
- Your use of the service.
- Your User Content.
- Quotes, project terms, pricing, approvals, customer communications, or work performed by you or your business.
- Your violation of these Terms.
- Your violation of law or the rights of another person or business.
Termination
You may stop using GetTheQuote at any time. We may suspend or terminate your access if you violate these Terms, create risk for the service, fail to pay fees when due, or use the service in a way that may harm us, other users, customers, or third parties.
After termination, we may retain certain information as required or permitted by law, for security, backups, dispute resolution, compliance, and legitimate business purposes.
Governing Law and Disputes
These Terms are governed by the laws of Armenia, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Armenia, unless applicable law requires otherwise.
Before filing a claim, you agree to contact us and try to resolve the dispute informally.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as posting the updated Terms in the application or sending notice to the email associated with an account.
Updated Terms are effective when posted unless a later effective date is stated. Continued use of GetTheQuote after updated Terms become effective means you accept the updated Terms.
